DigiVital Solutions “us”, or “we” provides its services under the brand name of Digivitalsolutions.com to Jobseekers, Employers, and Advertisers based on their requirements and does not take any responsibility for the content posted by them on our website Digivitalsolutions.com, the sole responsibility of the content posted by, employers, advertisers or partners stays with them and DigiVital solutions, any of its sister concern or any brand cannot be held liable for it. If any of the content results in loss, damage, or dispute to any party due to content posted on our website, that would be the matter between concerned parties and DigiVital solutions cannot be considered as a party in dispute in whatsoever case, Digivitalsolutions.com is only a content display platform for various parties and does not hold any right on any content posted by any of our stakeholders (Employer, Advertisers, Partners etc.) but if any party raised any objection on content on website, we hold the right to remove or delete the content from the website in whatsoever case without answerable to any party.
This Terms and Conditions Agreement (“Agreement”), including the Digivitalsolutions.com Privacy Policy which is hereby incorporated into this Agreement by reference, sets forth the legally binding terms for your use of the Services. The current version of this Agreement was first updated on 23rd Feb 2023, and becomes effective from 23rd Feb, 2023. By accessing and using the Services, you agree to comply with and be bound by this Agreement, whether you are visiting the Site (“Visitor”) or you are a “Member” (which means that you have registered on the Site). The term “User” refers to both Visitors and Members or any of our partners. If you sign up for additional features and services that are governed by additional terms and conditions, we will inform you accordingly when you sign up for these additional features and services. Unless otherwise provided by the additional terms and conditions, they are hereby incorporated into this Agreement by reference. Job Seekers
In order to use the Services, you don’t need to create an account on the Site Digivitalsolutions.com. After Clicking the “Apply Now” button on Job Posting candidate will be redirected to third-party website or display the concerned employer mail id. Candidates can send visit that website and apply or send resume by mail on the displayed mail id.
(“Account”). The site is a public site with free access and Digivitalsolutions.com assumes no liability for the quality and genuineness of responses. Digivitalsolutions.com cannot monitor the responses that a person may receive in response to information he/she has displayed on the site. The individual/company would have to conduct its own background checks on the bonafide nature of all response(s).
Candidate placement Fees:
Digivitalsolutions.com never ask for payments/fees from candidates for doing a placement. Digivital solutions shall not be responsible for any kind of transactions held between the job seeker and any Employer/Consultant.
Third Parties and Other Users
Services – Ownership and Restrictions
You acknowledge that all the intellectual property rights in the Services (excluding any Content provided by Users) are owned by Digivitalsolutions.com, or Digivitalsolutions.com content licensors. You agree not to (a) reproduce, modify, publish, transmit, distribute, publicly perform or display, sell, or create derivative works based on the Services or the Digivital Solutions Content and (b) rent, lease, loan, or sell access to the Services. Content means any work of authorship or information, including Jobs, Company Placement Papers, Interview Reviews, reports, Community comments, ads, opinions, postings, messages, text, files, images, photos, works of authorship, e-mail, or other materials.

Content from other Users, advertisers, and other third parties is made available to you through the Services. Because we do not control such Content, (a) you agree that we are not responsible for any such Content, including advertising and information about third-party products or services, employer, interview processes, job descriptions or job postings, and any other information provided by other Members through the Job posting, comments, and (b) we make no guarantees about the accuracy, currency, suitability, or quality of the information in such Content, and we assume no responsibility for unintended, objectionable, inaccurate, misleading, or unlawful Content made available by other Users, advertisers, and third parties.
Responsibility
Your interactions with other Users on the Services or with advertisers, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and the other User or advertiser. You agree that we are not responsible for any loss or damage incurred as the result of any such dealings or with respect to any other User’s use or disclosure of information about you that you have provided to publicly available sections of the Services. If there is a dispute between you and any third party (including any User), we are under no obligation to become involved; however, we reserve the right, but have no obligation, to monitor disputes between you and other Users.
Refund Policy, Refund & Cancellation Policy:
Job Seekers, Corporates, Employers & Partners.
Digivitalsolutions.com is not charging any amount for job postings or to apply for Job post.
Training courses will not be entertained to be posted as Jobs and there won’t be any refund against misusing the job posting platform.
No Institute’s Mail/Call letter/SMS will be approved unless they have internal hiring.
KYC update is mandatory for all recruiters and Institutes, Jobs will be approved only after a successful KYC verification
Acceptable Use and Conduct
You are solely responsible for any and all Content that is posted through your Account on the Services and for your interactions with other Users
Prohibited Content
You agree that you will not post any Prohibited Content or use any Prohibited Content in connection with the Services. “Prohibited Content” is Content that: (i) is offensive or promotes racism, bigotry, hatred or physical harm of any kind against any group or individual, or is pornographic or sexually explicit in nature; (ii) bullies, harasses or advocates stalking, bullying, or harassment of another person; (iii) involves the transmission of “junk mail”:, “chain letters,” or unsolicited mass mailing, or ,”spamming,”; (iv) is false or misleading or promotes, endorses or furthers illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous; (v) promotes, copies, performs or distributes an illegal or unauthorized copy of another person’s work that is protected by copyright or trade secret law, such as providing pirated computer programs or links to them, providing information to circumvent manufacturer-installed copy-protection devices, or providing pirated music, videos, or movies, or links to such pirated music, videos, or movies; (vi) is involved in the exploitation of persons under the age of eighteen (18) in a sexual or violent manner, or solicits personal information from anyone under eighteen (18); (vii) provides instructional information about illegal activities such as making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses and other harmful code; (viii) solicits passwords or personally identifying information for commercial or unlawful purposes from other Users; (ix) except as expressly approved by us, involves commercial activities and/or promotions such as contests, sweepstakes, barter, advertising, or pyramid schemes; (x) contains viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or similar software; or ; (xi) posts or distributes information which would violate any confidentiality, non-disclosure or other contractual restrictions or rights of any third party, including any current or former employers or potential employers, or (xii) otherwise violates the terms of this Agreement or creates liability for us.
Representations Regarding Your Content
You represent and warrant that: (a) you own the Content posted by you on the Service or otherwise have the right to grant the license set forth in this Agreement, (b) your Content does not violate the privacy rights, publicity rights, copyright rights, or other rights of any person, (c) by providing or posting your Content, you do not violate any confidentiality, non-disclosure, or contractual obligations you might have towards a third party, including your current or former employer or any potential employer, (d) any information you provide in a Job posting, advertisements is correct, and (e) any information you provide about your current, past or potential status as a user is correct and complete. Please make sure that you only provide information to the Services that you are allowed to provide without violating any obligations you might have towards a third party, including any confidentiality, non-disclosure or contractual obligations. Please do not provide any information that you are not allowed to share with others, including by contract or law; please note that any information you provide will be accessible by to employers to ensure that you will get more job opportunities but the ownership of the content will stays with you.
Enforcement by Digivitalsolutions.com
Any use of the Services in violation of this Agreement may result in, among other consequences, termination or suspension of your rights to use the Services. We may disclose information about your use of the Services in accordance with our privacy policy. We have the right (but not the obligation) to review any Content and delete (or modify) any Content that in our sole discretion violates this Agreement or which is Prohibited Content, or may otherwise violate the rights, harm, or threaten the safety of any User or any other person, or create liability for us or any User. We reserve the right (but have no obligation) to investigate and take appropriate legal action in our sole discretion against you if you violate this provision or any other provision of this Agreement, including without limitation, removing Content from the Services (or modifying it), terminating your Account, reporting you to law enforcement authorities, and taking legal action against you. You are solely responsible for creating backup copies of and replacing any Content you post on the Services at your sole cost and expense.
Lawful Use
You will use the Services in a manner consistent with any and all applicable laws and regulations and solely for lawful purposes. The Services are for the personal use of Users only. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from your Content without notice and may result in the suspension or termination of your Account.
No Disruption
You will not: (i) cover or obscure any banner advertisements on the Services, or any Digivitalsolutions.com page via HTML/CSS, scripting, or any other means, (ii) interfere with, disrupt, or create an undue burden on the Services or the networks or services connected to the Services; (iii) introduce software or automated agents to the Services, or access the Service so as to produce multiple accounts, generate automated messages, or to strip or mine data from the Services; or (iv) interfere with, disrupt, or modify any data or functionality of the Services.
Miscellaneous
You will not attempt to impersonate another User or person, including any of our employees. You will use the Services in a manner consistent with any and all applicable laws and regulations.

The Services may contain links to third-party websites (“Third-Party Websites”) (a) placed by us as a service to those interested in this information, or (b) posted by other Members. You use all such links to Third-Party Websites at your own risk. We do not monitor or have any control over and make no claim or representation regarding Third-Party Websites. To the extent such links are provided by us, they are provided only as a convenience, and such link to a Third-Party Website does not imply our endorsement, adoption or sponsorship of, or affiliation with, such Third-Party Website. When you leave the Site, our terms and policies no longer govern.
Copyright Policy
It is our policy to terminate membership privileges of any Member who repeatedly infringes copyright upon prompt notification to us by the copyright owner or the copyright owner’s legal agent. We assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any communication with other Users. We are not responsible for any problems or technical malfunction of any hardware and software due to technical problems on the Internet or at the Site or combination thereof, including any injury or damage to Users or to any person’s computer related to or resulting from participation or downloading materials in connection with the Services. Under no circumstances shall we be responsible for any loss or damage, including personal injury or death, resulting from use of the Services or from any Content posted on the Site or transmitted to Users, or any interactions between Users of the Services, whether online or offline. Partners(3rd Party) Mailer campaigns
For the mailers sent on behalf of partners (3rd Party), our partners take complete responsibility of any damage caused to recipients or anybody due to the information in the mail. Our partners are fully aware of the mailer content & recipients to whom the mail has been sent to. DigiVital Soltuions partners use our mailer services to engage subscribers (recipients). Please read the terms partners or “3rd Party” as, one who is in partnership with DigiVital Soltuions to use our services or resources.
Limitation on Liability
In no event shall we be liable to you or any third party for any lost profit or any indirect, consequential, exemplary, incidental, special or punitive damages arising from your use of the Services, even if we have been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, our liability to you for any damages arising from or related to your use of the Services (for any cause whatsoever and regardless of the form of the action.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental of consequential damages, so the above limitation or exclusion may not apply to you and you may also have other legal rights that vary from jurisdiction to jurisdiction.
Miscellaneous
Amendments
This Agreement may be modified by us from time to time. If we make material changes to the Agreement, we will notify you by sending an e-mail or you need to check the website for any updates. You agree that such an amended Agreement will be effective thirty (30) days after being sent to you, and your continued use of the Services after that time shall constitute your acceptance of the amended Agreement.
Force Majeure
Any delay in the performance of any duties or obligations of either party will not be considered a breach of this Agreement if such delay is caused by a labor dispute, shortage of materials, fire, earthquake, flood, war, terrorism, governmental act, failures of common carriers (including Internet service providers),acts of God, or any other event beyond the control of such party, provided that such party uses reasonable efforts, under the circumstances, to notify the other party of the circumstances causing the delay and to resume performance as soon as possible.
Release
To the maximum extent permitted by applicable law, you hereby release us, our officers, employees, agents and successors from claims, demands any and all losses, damages, rights, claims, and actions of any kind including personal injuries, death, and property damage, that is either directly or indirectly related to or arises from (i) any interactions with other Users, or (ii) your participation in any of our offline events.
Indemnity
You agree to defend, indemnify, and hold us, our subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your use of the Services and arising from your breach of any provision of this Agreement.
Governing Law and Arbitration
This Agreement shall be governed by the laws of the State of Maharashtra without giving effect to any conflict of laws principles that may provide the application of the law of another jurisdiction. You agree to submit to the personal jurisdiction of the state courts located within Pune and the federal courts in Pune. Any claim or dispute in connection with this Agreement shall be resolved in a cost-effective manner through binding non-appearance-based arbitration. The arbitration shall be initiated through an established alternative dispute resolution provider mutually agreed upon by the parties. The alternative dispute resolution provider and the parties must comply with the following rules: a) the arbitration shall be conducted by telephone, online and/or be solely based on written submissions, the specific manner shall be chosen by the party initiating the arbitration; b) the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; and c) any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. Notwithstanding the foregoing, we may seek injunctive or other equitable relief to protect its intellectual property rights in any court of competent jurisdiction.
Other
This Agreement constitutes the entire agreement between you and us regarding the use of the Services. Our failure to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. The section titles in this Agreement are for convenience only and have no legal or contractual effect; as used in the Agreement, the word including means “including but not limited to. Job Posting
digivitalsolutions.com shall place the information relating to a job vacancy in the Job opening section & such other job-related sections on the website digivitalsolutions.com or sites which we have collaboration with or/and as digivitalsolutions.com may deem fit and proper but such additional web hosting shall be without any extra cost to the employer/consultant/HR. After submitting the job Post all content will be reviewed and approved by our team. The insertion so displayed in the job posting section of digivitalsolutions.com shall be for a fixed period (currently 60 days), which period is subject to change without notice. Every instance of posting a new job gives you an additional fixed period (currently 30 days) starting from the date on which the listing is refreshed and shall be counted as a fresh posting and no duplicate job shall be allowed under this.
digivitalsolutions.com reserves its right to reject any job posting provided by the subscriber without assigning any reason either before uploading or after uploading the vacancy details, but in such an eventuality, any amount so paid for may be refunded to the subscriber on a pro-rata basis at the sole discretion of digivitalsolutions.com.
By posting/uploading a job posting on the website you confirm that you have obtained all licenses/permits as are necessary for recruitment and digivitalsolutions.com shall not be held responsible for any claims, or damages arising out of actions/claims that may be made in relation to the same.
digivitalsolutions.com has the right to make all such modifications/editing of the vacancy details in order to fit its database.
The Subscriber/Recruiter will provide a minimum of 1 email id for vacancies posted on digivitalsolutions.com in the job section to collect response(s) if any. The contact information given by the subscriber for all listings should be the same and the subscriber cannot give multiple contact information/data for the purpose of listing. Also, we allow the posting of information only email-id i.e. only the official mail id from associated with the company website address on the job display page.
All information intimated by the subscriber/recruiter and displayed by digivitalsolutions.com on digivitalsolutions.com becomes public knowledge and digivitalsolutions.com may at its sole discretion include the vacancy intimated by a subscriber for display on digivitalsolutions.com in any other media including the print media at no extra costs to the subscriber and digivitalsolutions.com shall not be held liable for usage/publicity of such information.
digivitalsolutions.com offers neither guarantee nor warranties that there would be a satisfactory response or any at all response once the job is put on display.
digivitalsolutions.com shall in no way be held liable for any information received by the subscriber and it shall be the sole responsibility of the subscriber to check, authenticate and verify the information/response received at its own cost and expense.
digivitalsolutions.com would not be held liable for any loss of data, technical or otherwise, information, particulars supplied by the subscriber, due the reasons beyond its control like corruption of data or delay or failure to perform as a result of any causes or conditions that are beyond digivitalsolutions.com’s reasonable control including but not limited to strike, riots, civil unrest, Govt. policies, tampering of data by unauthorized persons like hackers, war and natural calamities.
The subscriber/Recruiter shall be deemed to give an undertaking to digivitalsolutions.com that the jobs sought to be advertised on the jobs section of Digivitalsolutions.com are in existence, are genuine and that the subscriber/recruiter has the authority to advertise for such jobs. Posting a job on digivitalsolutions.com automatically activates this undertaking.
The subscriber/Recruiter must give an undertaking to digivitalsolutions.com that there will be no fee charged from any person who responds to jobs advertised on the jobs section of digivitalsolutions.com for processing of applications/responses from such person. Posting a job on digivitalsolutions.com automatically activates this undertaking.
digivitalsolutions.com reserves its right to change the look, feel, design, prominence, depiction, and classification of the job posting section of digivitalsolutions.com at any time without assigning any reason and without giving any notice.
The subscriber shall be assigned password (s) by digivitalsolutions.com to enable the subscriber to post vacancies on the site in agreed upon section(s), but the sole responsibility of the safe custody of the password shall be that of the subscriber and digivitalsolutions.com shall not be responsible for data loss/theft of data/corruption of data or the wrong usage/misuse of the password and any damage or leak of information and its consequential usage by a third party. digivitalsolutions.com undertakes to take all reasonable precautions at its end to ensure that there is no leakage/misuse of the password granted to the subscriber.
The User of these services does not claim any copyright or other Intellectual Property Right over the data uploaded by him/her on the website
All disputes arising out of the transactions between a user and digivitalsolutions.com will be resolved in accordance with the laws of India as applicable.
All Disputes arising out of the transactions between a user and digivitalsolutions.com will be subject to the jurisdiction of Courts situated in Pune/Maharashtra only.
The subscription is neither re-saleable nor transferable by the subscriber to any other person, corporate body, firm or individual.

Responsibility for ensuring that material submitted for inclusion on the Site complies with applicable International and National law is exclusively on the advertisers and digivitalsolutions.com will not be responsible for any claim, error, omission or inaccuracy in advertising material. digivitalsolutions.com reserves the right to omit, suspend or change the position of any advertising material submitted for insertion. Acceptance of advertisements on the Site will be subject to digivitalsolutions.com terms and conditions which are available on request.
Manual Shortlisting
digivitalsolutions.com agrees to provide the service to the subscriber only for the duration and the number of vacancies contracted for, to the best of its ability and digivitalsolutions.com shall in no way be held liable for any information received by the subscriber and it shall be the sole responsibility of the subscriber to check, authenticate and verify the information/response received at its own cost and expense.
digivitalsolutions.com will make best efforts to use the parameters provided by the subscriber to short list, but takes no responsibility for the accuracy of the shortlisting based on the parameters for selection as specified by the subscriber. digivitalsolutions.com would not be held liable for any loss of data technical or otherwise, information, or particulars supplied by the customers due to the reasons beyond its control like corruption of data or delay or failure to perform as a result of any causes or conditions that are beyond digivitalsolutions.com’s reasonable control including but not limited to strike, riots, civil unrest, Govt. policies, tampering of data by unauthorized persons like hackers, war and natural calamities
digivitalsolutions.com will commence providing services only upon receipt of amount/charges upfront either from the subscriber or from a third party on behalf of the subscriber. The payment for service once subscribed to by the subscriber is not refundable and any amount paid shall stand appropriated.
This subscription is neither re-saleable nor transferable by the subscriber to any other person, corporate body, firm or individual.
The User of these services does not claim any copyright or other Intellectual Property Right over the data uploaded by him/her on the website.
It is the responsibility of Job Seekers to verify the correctness and authenticity of the claims made by recruiters. We merely act as facilitators and do not as agents for any recruiter.
Payments to recruiters are not advised and shall be at your own risk.
All disputes arising out of the transactions between a user and digivitalsolutions.com will be resolved in accordance with the laws of India as applicable.
All Disputes arising out of the transactions between a user and digivitalsolutions.com will be subject to the jurisdiction of Courts situated in Pune/Maharashtra alone.
Any actions taken by an employer/recruiter on the basis of the background check report or otherwise is the employer’s/recruiter’s responsibility alone and digivitalsolutions.com will not be liable in any manner for the consequences of such action taken by the user.
digivitalsolutions.com would not be held liable for any loss of data technical or otherwise, information, or particulars supplied by the customers due to reasons beyond its control like corruption of data or delay or failure to perform as a result of any causes or conditions that are beyond digivitalsolutions.com’s reasonable control including but not limited to strike, riots, civil unrest, Govt. policies, tampering of data by unauthorized persons like hackers, war and natural calamities.
The subscriber/Recruiter
The user shall give an undertaking to digivitalsolutions.com that the jobs sought to be filled through digivitalsolutions.com are in existence, and genuine and the subscriber has the authority to recruit /advertise for such vacancies.
The user shall ensure compliance with all applicable laws for the protection of the personal details of the users whose profiles are accessed by them through digivitalsolutions.com including but not limited to compliance the Telecom Commercial Communications Customer Preference Regulations, 2010 as also rules, regulations, guidelines, bye laws and notifications made there under, while accessing or feeding any resume/ insertion or information/data into the computers, computer systems or computer networks of digivitalsolutions.com. Any unsolicited calls or emails sent to a candidate outside the use for Job openings will be taken as a direct reason for termination of services and no refund will be made under such conditions.

This subscription is neither re-saleable nor transferable by the subscriber to any other person, corporate body, firm or individual concern
The subscriber shall be assigned a password (s) by digivitalsolutions.com to enable the subscriber to access all the information received through the software, but the sole responsibility of the safe custody of the password shall be that of the subscriber and digivitalsolutions.com shall not be responsible for data loss/theft of data/corruption of data or the wrong usage/misuse of the password and any damage or leak of information and its consequential usage by a third party. digivitalsolutions.com undertakes to take all reasonable precautions at its end to ensure that there is no leakage/misuse of the password granted to the subscriber.
The information on digivitalsolutions.com is for use by its subscribers alone and does not authorize the subscriber to download and use the data for commercial purposes. In case any one is found to be in violation of this then digivitalsolutions.com at its discretion may suspend its service/subscription and also may take such action as it may be advised. No refund will be processed under this case and the account will be terminated after due investigation.
The subscriber shall not use / circulate / forward a person’s resume hosted on the digivitalsolutions.com Network / Resumes to his / her current employer as mentioned by the person in his / her resume. All disputes arising out of the transactions between a user and digivitalsolutions.com will be resolved in accordance with the laws of India as applicable.
All Disputes arising out of the transactions between a user and digivitalsolutions.com will be subject to the jurisdiction of Courts situate in Pune/Maharashtra only.
Users agree to indemnify and hold harmless digivitalsolutions.com from any damages or claims for transmitting spam. Users are advised to change their passwords frequently in order to reduce the possibility of misuse of their accounts.
